E-Verify is an Internet-based program run by the Federal government that was implemented to eliminate the hiring of illegal aliens by US employers. The system compares information from employee’s Employment Eligibility Verification Form I-9 to data from U.S. government records. If the information matches, that employee is eligible to work in the United States. If there is a mismatch, E-Verify alerts the employer and the employee is allowed to work while he or she resolves the problem. The employee works with their employer to resolve the mismatch within eight work days from the response date. The program is operated by the Department of Homeland Security (DHS) in partnership with Social Security Administration.
The Federal government and most states require the use of E-Verify in hiring state agency employees and contractors. While use in the private sector of E-Verify has been growing slowly due to initial glitches in the system, according to the DHS, more than 404,ooo employers now use E-Verify with many companies enrolling in the program every week. E-verify requirements vary from state to state. (See News article). As the system’s problems have been worked out, states like Alabama and South Carolina require all employers to utilize E-Verify, states like Tennessee and North Carolina require employers to utilize E-Verify or some form of documentation, while states like California have eliminated most E-Verify requirements. While still not perfect, DHS claims an 85% accuracy rate in the E-Verify system. This is a significant improvement and is getting better all the time.
